By using this website, you agree to these terms. If you do not agree, do not use the site. Separate beta, evaluation, subscription, or software-license terms will apply before we provide software or paid services.
Development-preview status
This website describes software that is under active development. Features, compatibility, performance, pricing, availability, and release timing may change. Screens, diagrams, and workflow descriptions are illustrative and are not a promise that a feature will ship in a particular form or on a particular date.
Eligibility and accounts
You must be at least 16 and legally able to agree to these terms. If you use the site for an organization, you represent that you are authorized to do so. Provide accurate information, keep your credentials confidential, and notify us promptly if you suspect unauthorized account use. You are responsible for activity under your account.
Beta requests and communications
A beta request joins a review list. It does not create an entitlement, guarantee selection or timing, establish a purchase, or grant access to software. We may contact you about your request, account, security, support, or material changes to the service. Optional marketing communications may be declined at any time.
Acceptable use
You may not:
- use the site unlawfully, fraudulently, or to infringe another person’s rights;
- probe, scan, disrupt, overload, bypass, or interfere with the site or its security;
- introduce malware, scrape the site at unreasonable volume, or access accounts or systems without authorization;
- misrepresent your identity or submit information you do not have the right to provide; or
- copy, modify, or distribute site content except as permitted by law or with our written permission.
Your submissions
You retain ownership of information you submit. You give us a limited right to host, process, and use it to operate the site, review your request, respond to you, and improve product planning as described in our Privacy Policy. Do not submit confidential production materials, client footage, trade secrets, or sensitive personal information through website forms.
Our content and marks
The website, its design, text, graphics, software, product names, and logos are owned by AlexPearce3D, Inc. or its licensors and are protected by intellectual-property laws. No rights are granted except the limited right to use the website under these terms. Third-party names and marks belong to their respective owners.
Third-party services and links
The site depends on third-party infrastructure and may link to third-party services. We do not control their availability, content, or independent practices. Your use of a third-party service may be governed by its own terms.
Availability and account action
We may change, suspend, or discontinue website features and may restrict or terminate access when reasonably necessary for security, maintenance, legal compliance, or a violation of these terms. You may stop using the site at any time and may request account deletion by emailing alex@sim-plates.com.
Disclaimers
To the fullest extent permitted by law, the website is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Nothing on the site is professional, legal, or production-reliability advice. Some jurisdictions do not allow certain disclaimers, so they may not apply to you.
Limitation of liability
To the fullest extent permitted by law, AlexPearce3D, Inc. and its directors, officers, employees, and contractors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business interruption arising from the website. Our aggregate liability arising from the website will not exceed US $100. These limits do not apply where liability cannot lawfully be limited.
Governing law
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Courts with jurisdiction in California will have exclusive jurisdiction, except where applicable consumer law gives you the right to bring a claim elsewhere.
Changes and contact
We may update these terms by posting a revised version and changing the effective date. Material changes will apply prospectively, with additional notice where required. If a provision is unenforceable, the remaining provisions continue in effect. These terms are the complete agreement about the website preview.
